Server99 is dedicated to providing our customers with
high quality services. The terms and conditions listed
here are
necessary to ensure that we continue to provide the best
possible service to all of our customers while at the
same time
satisfying our legal and ethical responsibilities.
SECURITY
Server99 is a
provider of self managed dedicated servers. It is
responsible for security at the network level. You, as a
customer, are responsible to take security precautions
to protect your own server.

You are solely responsible for any security
breaches of the server under your control. |

You must protect any confidential data such as
account passwords, server passwords, database
data, etc. |
Customers must take all appropriate security
measures to safeguard their servers from attack,
and to ensure proper
functioning of their servers within our network. |
If for any reason a server becomes compromised
by unauthorized parties, we reserve the right to
isolate the infected server, and remove it
completely from our network. The owner of such a
server will be contacted by our technical
support team to effectively come up with a
resolution. |

If a server has been
compromised and needs to be reinstalled, the
customer will be charged per our standard OS
reinstall
pricing. |

Network Responsibility
Server99
maintains a network uptime guarantee of 99.9%. You
as a customer are expected to use the Server99
network
responsibly to help us provide the best network
performance possible.
Customers are expressly prohibited from using the
server99 network or its services in a manner that
adversely affects other
customers, or the network's performance. These
prohibited uses include but not limited to:

Attacking or attempting to gain unauthorized
access to servers and services that belong to
Server99, its customers, or to any other entity
on the Internet (i.e. computer hacking). |

Engaging in any behavior, or activity that
directly or indirectly results in a server being
the target of a Denial of
Service (DoS) attack. |
|
. |
Unauthorized access to or use of data, systems
or networks, including any attempt to probe,
scan or test the vulnerability of a system or
network or to breach security or authentication
measures (including those belonging to Server99
and its customers) without express authorization
of the owner of the system or network monitoring
data or traffic on any network or system without
the authorization of the owner of the system or
network |

Interference with service to any user of the
Server99 or other network including, without
limitation, mail bombing,
flooding, deliberate attempts to overload a
system and broadcast attacks. |

Use of an Internet account or computer without
the owner's authorization, including, but not
limited to Internet scanning (tricking other
people into releasing their passwords), password
robbery, security hole scanning, and port
scanning. |

. |
Forging of any TCP-IP packet header or any part
of the header information in an e-mail or a
newsgroup posting. |
Lawful Use
Using any
Server99 service or product for the purpose of
participating in any activity dealing with subject
matters that are
prohibited under applicable law is prohibited.
Transmission, distribution, or storage of any
information, data or material in violation of United
States or state regulation
or law, or by the common law, is prohibited. This
includes, but is not limited to the material or data
that:

Compromises the safety of a person, public or
nation. |

Defeats any copyright or any intellectual
property right. |

Exposes any confidential information of another
person or an organization |

Is defamatory, violent, threatens violence,
contains harassing contents, or hate speech |

Infringes the intellectual property right
or copyright or trademark. |

Is otherwise malicious or may result in
retaliation against Server99 by offended parties |
|
. |
Adult Material
Server99
maintains a 100% adult content free network. Any
adult content found on any servers located
within the Server99 network will be in violation
of our AUP and will be disconnected immediately. |
AMMENDMENTS TO AUP
SERVER99
RESERVES THE RIGHT TO MODIFY ITS AUP AS PER THE
CIRCUMSTANCES TO COPE UP WITH THE DIVERSE AND EVER
GROWING COMMUNITY OF INTERNET.
Violation of AUP
THE ACCEPTANCE
OF SERVICES OF SERVER99 IMPLIES THE ACCEPTANCE OF
AUP BY THE CUSTOMER.
INDIRECT OR ATTEMPTED VIOLATIONS OF THE AUP, AND
ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON
BEHALF OF A USER OF SERVER99 SHALL BE CONSIDERED
VIOLATIONS OF THE AUP BY SUCH USER.
SERVER99 may without notice to you, suspend your
service or remove any content transmitted via the
SERVER99 service if it
discovers facts that lead it to reasonably believe
your service is being used in violation of this AUP.
SERVER99 will attempt
to contact you prior to suspension of network access
to your server(s), however, prior notification is
not assured.
Disclaimer of
Responsibility
SERVER99 is
under no duty, and does not by this AUP undertake a
duty, to monitor or police our customers' activities
and disclaims any responsibility for any misuse of
the SERVER99 network. SERVER99 disclaims any
obligation to any person who has not entered into an
agreement with SERVER99 for services.
